1. ACCEPTANCE OF TERMS OF SERVICE

These Terms of Service (“Terms”) apply to any access to, or use of, any services made available by Cryptonite LLC (cryptonite,” “we,” “us,” or “our”) using the website [gocryptonite.com] (the “Site”) and any other related services provided by Instacoin (collectively, the “Services”). Please read these Terms carefully before using the Services. By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Services.

2. ELIGIBILITY

General Requirements. The Services are intended solely for users who are 18 years of age or older and who satisfy the criteria described in these Terms. By using our Services, you represent and warrant that: (a) You are of legal age to form a binding contract; (b) You have not been previously suspended or removed from using the Services; and (c) You have full power and authority to agree to these Terms.

Restricted Locations. You may not use the Services if you are located in, or a citizen or resident of, any jurisdiction where your use of the Services would be illegal or otherwise violate any applicable law. Instacoin may restrict access to the Services in certain locations at its sole discretion.

3. DESCRIPTION OF SERVICES

cryptonite provides a credit-based transaction system that allows users to purchase and transfer credits in exchange for services. cryptonite does not provide banking, investment, or financial advisory services.

4. COMPLIANCE WITH ANTI-MONEY LAUNDERING (AML) POLICY

cryptonite is committed to complying with all applicable laws, including but not limited to the Bank Secrecy Act, the US Patriot Act, OFAC Requirements, and all regulations enforced by the Financial Crimes Enforcement Network (FinCEN). cryptonite has implemented a comprehensive Know Your Customer (KYC) and Anti-Money Laundering (AML) Program. cryptonite may collect certain user information based on location and transaction size, including but not limited to:

• Full Name
• Phone Number
• Email Address
• Date of Birth
• Address
• Government-issued ID

Adherence to the Privacy Policy. Failure to provide the necessary KYC documentation may result in restrictions on the use of Services or account suspension.

Travel Rule Compliance. Transactions over $3,000 may be subject to additional review under FinCEN’s Travel Rule regulations. Additional details may be requested for larger transactions, including proof of transaction purpose and counterparties involved.
Enhanced Due Diligence. cryptonite reserves the right to perform additional due diligence on accounts with high transaction volumes or activity deemed unusual. If a user fails to provide the requested information, their account may be suspended.
OFAC Compliance. cryptonite complies with the regulations set forth by the Office of Foreign Assets Control (OFAC) and prohibits transactions involving individuals, entities, or jurisdictions listed on the OFAC Specially Designated Nationals (SDN) List or subject to other trade embargoes and sanctions. cryptonite conducts screening of users and transactions to prevent dealings with sanctioned parties. If a transaction is flagged for potential OFAC violations, it may be delayed, restricted, or canceled, and cryptonite may be required to report such activities to the relevant authorities.

5. FEES & TRANSACTION LIMITS

cryptonite may charge service fees on transactions involving credit purchases, transfers, and redemptions. Any applicable fees will be displayed before a transaction is finalized. All fees are non-refundable. Users are subject to daily and monthly transaction limits as determined by cryptonite’s risk and compliance policies.

6. RESTRICTIONS ON USE

By using cryptonite’s Services, you agree NOT to:

• Engage in fraudulent, deceptive, or illegal transactions.
• Use the Services for money laundering, terrorist financing, or illicit activities.
• Attempt to interfere with or disrupt the Services, including through hacking or unauthorized access.
• Misrepresent your identity or impersonate any individual or entity.

Failure to adhere to these restrictions may result in account termination and legal action.

7. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

cryptonite provides its Services on an “AS-IS” and “AS-AVAILABLE” basis. We make no warranties or guarantees regarding the availability, reliability, or security of our platform.

a. To the maximum extent permitted by law, cryptonite is not liable for:

• Any losses due to unauthorized access or fraudulent transactions.
• Delays in processing ACH payments due to banking restrictions.
• Interruptions caused by system maintenance or third-party service failures.
• cryptonite is not responsible for losses, chargebacks, errors, or fraud related to merchant activity. Your use of the Services is at your own risk, and you assume full responsibility for your transactions.

8. DISPUTE RESOLUTION & GOVERNING LAW

without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in Nevada, and you waive the right to participate in a class action lawsuit.

9. TERMINATION & MODIFICATION OF SERVICES

cryptonite reserves the right to:

• Modify or terminate any part of the Services at any time.
• Suspend or terminate user accounts that violate these Terms or applicable laws.
• Change the fee structure or transaction limits at its sole discretion.
